Welcome to Red Belt Software. These Terms and Conditions (“Terms”) govern your access to and use of the Red Belt Software website, services, and related products (collectively, the “Services”). By using our Services, you agree to be bound by these Terms. If you do not agree, you may not use our Services.
1. Scope of Services
- Cloud SaaS Platform: Red Belt Software is offered as a cloud-based SaaS solution. It is not downloadable. We may make versions available for mobile/tablet in the future.
- Website Hosting & Design: We build and host websites for clients using GoDaddy hosting services. While we manage hosting, clients retain ownership of their domain names and may request to migrate their websites to another provider if they leave our Services.
- Custom Work & Training: We provide custom development for websites as well as tutorials and training videos.
- Third-Party Content: We display reviews from Google, Yelp, and other platforms and reserve the right to do so without prior permission.
2. Accounts & Access
- Visitors to our website are not required to create accounts to browse.
- Users may register accounts to receive newsletters or alerts. These accounts are strictly for subscription purposes.
- All paying clients must create accounts to use Red Belt Gym, which has its own policy → Red Belt Gym Terms & Conditions.
3. Payments & Contracts
- Red Belt Software does not currently sell services directly online. All paid services are governed by a separate written contract entered into after a demo.
- Unless otherwise specified in a signed contract, payments are non-refundable.
- Free trials are not offered. Free demos may be scheduled with our team.
4. Acceptable Use
You may not use our Services to:
- Engage in spam, harassment, hacking, or illegal activities.
- Resell, sublicense, or share access without authorization.
- Reverse-engineer, copy, or attempt to replicate our code, designs, or proprietary content.
We reserve the right to suspend or terminate access if you violate these Terms.
5. Intellectual Property
- All software code, trademarks, logos, website designs, and related content remain the exclusive property of Red Belt Software.
- Clients retain ownership of their uploaded content and data but grant Red Belt Software a license to host, display, and provide Services around it.
6. Service Availability & Liability
- We do not guarantee 100% uptime. While we work to maintain reliable services, interruptions may occur.
- Because we rely on GoDaddy hosting, Red Belt Software is not responsible for outages, bugs, or lost data arising from GoDaddy or other third-party services.
- All data backups and exports are ultimately the customer’s responsibility.
7. Privacy & Data Protection
Our handling of personal information is governed by our Privacy Policy, available at: https://rbs.testbrianweb.com/privacy-policy.
8. Termination
- We may suspend or terminate your access to Services for violations of these Terms, non-payment, or as required by law.
- Clients may terminate Services in accordance with the written contract they signed with Red Belt Software.
9. Dispute Resolution & Governing Law
- These Terms are governed by the laws of the State of Texas.
- Any disputes shall be resolved exclusively by binding arbitration in Texas, except where prohibited by law.
10. Force Majeure
Red Belt Software is not liable for delays, outages, or loss of services caused by circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, wars, labor strikes, power outages, or failures of third-party hosting providers.
- During force majeure events, we reserve the right to make payments non-refundable.
11. Changes to Terms
We may update these Terms from time to time. Updates will be posted on this page with a new “Effective Date.” Continued use of our Services constitutes acceptance of the updated Terms.
12. Entire Agreement
These Terms, together with our Privacy Policy and any signed contracts, constitute the entire agreement between you and Red Belt Software.
